1.1. These Terms of Use of the Website (hereinafter – the Terms) establish the rules for access to and use of the website of the PUBLIC ORGANIZATION «YOUTH CLIMATE INITIATIVE «ROZVIY» (hereinafter – the Organization) under the domain name rozviy.org (hereinafter – the Website).

1.3. Any natural or legal person who accesses the Website or uses it in any manner is considered a user (hereinafter – the User). By using the Website, the User confirms that they have carefully read these Terms, understand their content, and agree to comply with them in full. If the User does not agree with any provision of the Terms, they must stop using the Website.
1.4. These Terms are developed in accordance with the Constitution of Ukraine, the Civil Code of Ukraine, the Law of Ukraine «On Public Associations», and other applicable legislation of Ukraine.
1.5. The Terms apply exclusively to relations between the Organization and Users arising in connection with access to and use of the Website. The internal activities of the Organization, relations between the Organization and its members, governing bodies, and other related persons are governed by the Charter of PO «ROZVIY» and other internal documents, and not by these Terms.
1.6. Issues of personal data processing and use of cookies are governed by a separate document – the Privacy Policy – which is posted on the Website.

The internal activities of the Organization, relations between the Organization and its members, governing bodies, and other related persons are governed by the Charter of PO «ROZVIY» and other internal documents, and not by these Terms.

TERMS AND DEFINITIONS
2.1. Website – a set of web pages, software code, textual, graphic, audiovisual and other materials, as well as technical means and functions available on the Internet under the domain name rozviy.org, administered by the Organization.
2.2. User – any legally capable natural person or duly registered legal entity that has access to the Website and uses it in any manner.
2.3. Website Content – any information and materials posted on the Website, including but not limited to texts, articles, news, analytical and educational materials, photos, videos, graphics, logos, design, documents, presentations, methodological materials, and other results of intellectual activity.
2.4. Website Forms – electronic forms, questionnaires, and other technical means of collecting information that the User may complete on the Website or via links from the Website, including contact forms, event registration forms, questionnaires in external services including Google Forms and other services.
2.5. Partners – legal or natural persons, organizations or institutions with which the Organization cooperates to implement its statutory objectives, projects, or events.
2.6. Fundraising – public informing about the need to finance certain activities, projects, or initiatives of the Organization, as well as acceptance of voluntary financial support from natural and legal persons in the forms предусмотренных by the legislation of Ukraine and internal documents of the Organization.

LEGAL STATUS OF THE ORGANIZATION AND NATURE OF INFORMATION ON THE WEBSITE
3.1. The Organization is a non-profit public association established to satisfy and protect public interests, develop the green economy in Ukraine, build a community of youth knowledgeable in climate and sustainable development issues, ensure youth participation in the processes of green recovery of Ukraine, and represent youth in climate policy.
3.2. The activities of the Organization are public in nature and carried out in accordance with the Charter of the Organization. The Organization cooperates with state authorities, local self-government bodies, enterprises, institutions, organizations, as well as Ukrainian and international partners.
3.3. The Website is an informational and communication platform of the Organization used for:
a) informing about the purpose, values, areas of activity, and projects of the Organization;
b) posting news, educational and analytical materials on climate, green economy, sustainable development, and related topics;
c) publishing information about events and opportunities for participation in them;
d) communication with Users via contact forms, email, and links to the Organization’s social media pages;
e) if necessary, informing about fundraising to support the activities of the Organization and its projects.
3.4. Information on the Website is of a general informational, educational, and communication nature. If certain information is created or presented in partnership with other organizations, this may be indicated separately.
3.5. Information contained on the Website is not an act of a state authority or local self-government body and does not establish direct legal obligations for Users, except as expressly provided by these Terms and law.
3.2. The activities of the Organization are public in nature and carried out in accordance with the Charter of the Organization. The Organization cooperates with state authorities, local self-government bodies, enterprises, institutions, organizations, as well as Ukrainian and international partners.

a) informing about the purpose, values, areas of activity, and projects of the Organization;
b) posting news, educational and analytical materials on climate, green economy, sustainable development, and related topics;
c) publishing information about events and opportunities for participation in them;
d) communication with Users via contact forms, email, and links to the Organization’s social media pages;
e) if necessary, informing about fundraising to support the activities of the Organization and its projects.
3.4. Information on the Website is of a general informational, educational, and communication nature. If certain information is created or presented in partnership with other organizations, this may be indicated separately.
3.5. Information contained on the Website is not an act of a state authority or local self-government body and does not establish direct legal obligations for Users, except as expressly provided by these Terms and law.

c) use of Website Forms and communication with the Organization via the Website;
d) general principles of posting information about fundraising and projects;
e) limitation of the Organization’s liability;
f) procedure for submitting requests and resolving disputes related to the use of the Website.
4.2. The Terms do not regulate the procedure for acquisition, termination, and exercise of membership in the Organization, governance of the Organization, distribution of powers of governing bodies, and other internal issues determined exclusively by the Charter and internal documents of the Organization.
4.3. If certain functions or services of the Website have additional rules or special terms of use, such information is posted directly in the relevant sections of the Website. In case of contradiction between such special rules and these Terms, the special rules for the relevant service shall prevail.

ACCESS TO THE WEBSITE AND TECHNICAL REQUIREMENTS
5.1. Access to the Website is free of charge for Users. The Website does not require mandatory registration or creation of personal accounts.
5.2. The User independently ensures the availability of technical means for Internet access, appropriate equipment, software, browser, and security tools. All costs associated with Internet access are borne by the User.
5.3. The Organization strives to maintain uninterrupted operation of the Website but does not guarantee that the Website will be available at any time or that its functioning will be completely error-free. The Website may be temporarily restricted or suspended due to maintenance, updates, modernization, change of hosting provider, cyber incidents, or other circumstances.
5.4. The Organization has the right, without prior notice to Users, to:
a) change the structure, design, and content of the Website;
b) change or limit the functionality of the Website;
c) temporarily suspend or completely terminate the operation of the Website.
5.5. If certain parts or functions of the Website are unavailable or operate incorrectly, this in itself cannot be considered a violation of User rights, provided that such limitation does not contradict imperative norms of Ukrainian legislation.

b) event registration forms implemented via external services, including Google Forms and other registration platforms;
c) links to selection forms for participants in projects or educational programs;
d) email address and links to the Organization’s social media pages for communication.
6.2. Submission of any information via Website Forms or external forms linked from the Website is carried out voluntarily by the User. The User guarantees that the data provided are truthful, accurate, and up to date.
6.3. The User has no right to:
a) knowingly provide false information;
b) provide personal data of third parties without their consent;
c) use Website Forms to post advertising or political information, unless expressly provided by the terms of the relevant form;
d) use forms to send spam, offensive, or discriminatory messages.
6.4. The Organization may use information received via Website Forms:
a) to respond to User requests;
b) to organize User participation in events and projects;
c) to send organizational information regarding the relevant event or project;
d) for internal accounting and reporting on the implementation of the Organization’s activities.
6.5. If the User gives consent to receive informational messages, the Organization may send news and information about its activities via email newsletters or other communication channels.
6.6. If relevant forms are implemented via external services, including Google Forms, the processing of information is also governed by the rules of the respective services.

RIGHTS AND OBLIGATIONS OF THE USER
7.1. The User has the right to:

b) use Website materials within the limits permitted by law and these Terms;
c) contact the Organization with requests, proposals, and comments via the communication means indicated on the Website;
d) receive responses from the Organization within reasonable timeframes.
7.2. The User is obliged to:
a) comply with these Terms and the legislation of Ukraine;
b) not perform actions that may disrupt the normal operation of the Website or cause damage to the Organization, its partners, or other Users;
c) refrain from attempts of unauthorized access to technical means of the Website, accounts of third-party services, or databases;
d) not use the Website for any unlawful actions, including fraud, distribution of malicious software, or infringement of intellectual property rights;
e) refrain from actions that may damage the reputation of the Organization.
7.3. The User understands that using the Website does not grant them the status of a member of the Organization and does not create labor, civil, corporate, or other legal relations between them and the Organization, except as directly arising from these Terms or separate agreements.

d) not respond to requests that constitute spam, contain insults, threats, or are submitted in bad faith;
e) in cases provided by law, contact competent authorities regarding abuses related to the use of the Website.
8.2. The Organization undertakes to:
a) conduct its activities in accordance with its Charter and the legislation of Ukraine;
b) within reasonable limits ensure the relevance of key information about the Organization on the Website;
c) review legitimate User requests and provide responses within timeframes established by law or internal procedures.

INTELLECTUAL PROPERTY
9.1. As a general rule, proprietary intellectual property rights to the Content posted on the Website belong to the Organization, unless otherwise expressly stated.
9.2. Certain materials may belong to partners, authors, experts, or other third parties. In such cases, rights to the use of such materials are determined by agreements between the Organization and the respective rights holders.
9.3. The User has the right to:
a) view the Website Content;
b) quote fragments of materials with indication of the full name of the Organization and a link to the Website as the source.
9.4. Without prior written consent of the Organization, it is prohibited to:
a) reproduce all or substantial parts of Website materials for commercial purposes;
b) modify, adapt, process, or create derivative works based on Website materials with their further distribution;
c) use logos, visual identity, and other elements of the Organization’s brand identity in a way that creates the impression of official cooperation or partnership if it does not exist.
9.5. If the Website contains an indication of an open Creative Commons license or other license for certain materials, the terms of use of such materials are determined by the relevant license.
9.2. Certain materials may belong to partners, authors, experts, or other third parties. In such cases, rights to the use of such materials are determined by agreements between the Organization and the respective rights holders.

10.2. Such links and materials are posted for User convenience or to inform about partner activities. This does not mean that the Organization fully shares all positions, opinions, or policies of the respective resources.
10.3. The Organization does not control the content, privacy policies, or terms of use of third-party resources and is not responsible for any consequences of User transitions to such links or use of such resources.
10.4. The User must independently familiarize themselves with the terms of use and privacy policies of third-party resources before using them.
10.2. Such links and materials are posted for User convenience or to inform about partner activities. This does not mean that the Organization fully shares all positions, opinions, or policies of the respective resources.
10.3. The Organization does not control the content, privacy policies, or terms of use of third-party resources and is not responsible for any consequences of User transitions to such links or use of such resources.
10.4. The User must independently familiarize themselves with the terms of use and privacy policies of third-party resources before using them.
SPECIFICS OF INFORMATION ABOUT PROJECTS, PROGRAMS, AND FUNDRAISING
11.1. The Website may post information about projects, programs, events, and other activities of the Organization, including those funded by donors, grantors, partners, or through voluntary support from citizens.
11.2. The Website may also post information about fundraising or other forms of support for the Organization’s activities. Such information may include fundraising goals, approximate budgets, contact details, and other information.
11.3. Currently, mechanisms for online payments directly through the Website may be absent or limited. If online donation functionality or other financial instruments are implemented, the procedure for donations, their targeted use, refund possibilities, reporting, and other aspects will be governed by a separate document – the Donation Collection Policy – posted on the Website.
11.4. If fundraising information is posted on the Website in the form of an announcement, the terms of such fundraising, its purpose, and details may additionally be defined in the text of the relevant announcement or attached documents, links, or informational materials.
11.5. Donors may receive individual reports on the use of support if this follows from agreements between the Organization and relevant donors or is provided for by project documentation.
11.2. The Website may also post information about fundraising or other forms of support for the Organization’s activities. Such information may include fundraising goals, approximate budgets, contact details, and other information.
11.3. Currently, mechanisms for online payments directly through the Website may be absent or limited. If online donation functionality or other financial instruments are implemented, the procedure for donations, their targeted use, refund possibilities, reporting, and other aspects will be governed by a separate document – the Donation Collection Policy – posted on the Website.
11.4. If fundraising information is posted on the Website in the form of an announcement, the terms of such fundraising, its purpose, and details may additionally be defined in the text of the relevant announcement or attached documents, links, or informational materials.
11.5. Donors may receive individual reports on the use of support if this follows from agreements between the Organization and relevant donors or is provided for by project documentation.
LIABILITY AND LIMITATION THEREOF
12.1. The Organization posts information on the Website in good faith and within available resources but cannot guarantee absolute completeness, accuracy, and error-free nature of all materials at any given time.
12.2. The Organization is not liable for any direct or indirect damages that may be caused to the User in connection with:
a) use or inability to use the Website;
b) technical failures in the operation of the Website or Internet infrastructure;
c) actions or inaction of third parties, including hosting providers, email services, software providers;
d) unauthorized actions of third parties aimed at interfering with the operation of the Website or Internet infrastructure.
12.3. The Organization is not responsible for the content of messages and materials sent by Users to the Organization via email, Website Forms, or social media, as well as for actions of Users based on information obtained from the Website.
12.4. If limitations of liability are expressly provided by imperative norms of Ukrainian legislation, the Terms shall be interpreted and applied within the maximum extent permitted by law.
12.2. The Organization is not liable for any direct or indirect damages that may be caused to the User in connection with:
a) use or inability to use the Website;
b) technical failures in the operation of the Website or Internet infrastructure;
c) actions or inaction of third parties, including hosting providers, email services, software providers;
d) unauthorized actions of third parties aimed at interfering with the operation of the Website or Internet infrastructure.
12.3. The Organization is not responsible for the content of messages and materials sent by Users to the Organization via email, Website Forms, or social media, as well as for actions of Users based on information obtained from the Website.
12.4. If limitations of liability are expressly provided by imperative norms of Ukrainian legislation, the Terms shall be interpreted and applied within the maximum extent permitted by law.
FORCE MAJEURE
13.1. The Organization is released from liability for full or partial non-fulfillment of obligations related to ensuring access to the Website if this resulted from force majeure circumstances.
13.2. Force majeure circumstances include, but are not limited to:
a) military actions, general mobilization, massive shelling, terrorist acts;
b) natural disasters, fires, floods, technological disasters;
c) prolonged disruptions in electricity supply, communication networks, or Internet infrastructure;
d) legal prohibitions or restrictions introduced by state authorities;
e) massive cyberattacks on the hosting provider’s infrastructure or other systems affecting the operation of the Website.1
3.3. During the period of force majeure, deadlines for fulfilling obligations related to technical support of the Website are extended for the duration of such circumstances.
13.2. Force majeure circumstances include, but are not limited to:
a) military actions, general mobilization, massive shelling, terrorist acts;
b) natural disasters, fires, floods, technological disasters;
c) prolonged disruptions in electricity supply, communication networks, or Internet infrastructure;
d) legal prohibitions or restrictions introduced by state authorities;
e) massive cyberattacks on the hosting provider’s infrastructure or other systems affecting the operation of the Website.1
3.3. During the period of force majeure, deadlines for fulfilling obligations related to technical support of the Website are extended for the duration of such circumstances.
PROCEDURE FOR SUBMITTING REQUESTS AND COMPLAINTS
14.1. The User may contact the Organization on any issues related to the use of the Website by emailing contact@rozviy.org or through other communication channels indicated on the Website.
14.2. The Organization reviews requests within a reasonable period, considering their complexity and volume, but generally no later than thirty calendar days from the date of receipt, unless another period is established by law.
14.3. If the User believes their rights have been violated in connection with the operation of the Website, they have the right to:
a) submit a written or electronic complaint to the Organization describing the essence of the violation;
b) in case of disagreement with the Organization’s response, contact competent state authorities or a court.
14.4. The Organization reserves the right not to respond to requests containing obscene language, insults, threats, incitement to hatred, or obvious abuse of the right to appeal.
14.2. The Organization reviews requests within a reasonable period, considering their complexity and volume, but generally no later than thirty calendar days from the date of receipt, unless another period is established by law.
14.3. If the User believes their rights have been violated in connection with the operation of the Website, they have the right to:
a) submit a written or electronic complaint to the Organization describing the essence of the violation;
b) in case of disagreement with the Organization’s response, contact competent state authorities or a court.
14.4. The Organization reserves the right not to respond to requests containing obscene language, insults, threats, incitement to hatred, or obvious abuse of the right to appeal.
APPLICABLE LAW AND DISPUTE RESOLUTION
15.1. These Terms and relations between the User and the Organization arising from the use of the Website are governed by the law of Ukraine.
15.2. All disputes, disagreements, or claims arising in connection with these Terms or the use of the Website shall, where possible, be resolved through negotiations between the User and the Organization.
15.3. If agreement is not reached through negotiations, the dispute shall be considered by the courts of Ukraine in accordance with jurisdiction rules established by procedural legislation of Ukraine.
15.2. All disputes, disagreements, or claims arising in connection with these Terms or the use of the Website shall, where possible, be resolved through negotiations between the User and the Organization.
15.3. If agreement is not reached through negotiations, the dispute shall be considered by the courts of Ukraine in accordance with jurisdiction rules established by procedural legislation of Ukraine.
AMENDMENT OF TERMS OF USE
16.1. The Organization has the right to amend these Terms unilaterally. The updated version of the Terms is posted on the Website.
16.2. Amendments enter into force from the moment the updated version of the Terms is published on the Website, unless otherwise expressly stated.
